Frequently Asked Questions About Injury Claims in North Carolina
How much does it cost to hire a personal injury lawyer in North Carolina?
Haase Law handles personal injury cases on a contingency fee basis: there are no attorney fees unless we win your case. The initial consultation is free. Clients remain responsible for case costs and expenses, which are typically deducted from any recovery.
How long do I have to file a personal injury claim in North Carolina?
In most North Carolina personal injury cases the statute of limitations is three years from the date of the injury (N.C. Gen. Stat. § 1-52). Wrongful death claims generally must be filed within two years. Some claims have shorter deadlines, and missing a deadline can permanently bar your case, so it is best to speak with an attorney early.
What is contributory negligence, and why does it matter in North Carolina?
North Carolina is one of only a few states that still follows pure contributory negligence. Under this rule, if an injured person is found even slightly at fault for the accident, they may be barred from recovering anything at all. Insurance companies use this rule aggressively in North Carolina, which is why how your claim is presented from the very beginning matters so much.
How long do I have to report a work injury in North Carolina?
You should report a workplace injury to your employer in writing as soon as possible and generally within 30 days. To protect your rights, a claim (Form 18) generally must be filed with the North Carolina Industrial Commission within two years of the injury. Reporting an injury to your supervisor alone is often not enough.
Will my case have to go to court?
Most personal injury and workers’ compensation claims settle without a trial. However, insurance companies tend to offer more when they know your attorney is genuinely prepared to try the case. Eric Haase has more than 30 years of litigation experience and prepares every case accordingly.
